Welcome to Barter. These Terms of Service ("Terms") govern your access to and use of the Barter platform, website, and services (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing Barter, you enter into a legally binding contract with the Barter team. If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to update these Terms at any time; continued use following updates constitutes your acceptance of the changes.
2. Eligibility and Access
Age Requirement
You must be at least 18 years of age to use Barter.
Invite-Only Status
Barter is an invite-only community. Access is a privilege, not a right. We reserve the right to revoke access at our sole discretion.
Verification
To maintain trust, we require users to authenticate via LinkedIn. You agree to provide accurate, current, and complete information during the sign-up process and to keep your profile updated.
3. The Nature of the Platform
Barter is a facilitator. We provide a space for verified individuals to list items and coordinate exchanges.
No Agency
Barter is not an auctioneer, broker, or party to any transaction between users.
"As-Is" Interactions
Any agreement made between users (the "Barter") is solely between those individuals. Barter does not guarantee the quality, safety, or legality of items listed.
4. User Conduct and Prohibitions
To keep the community safe, you agree not to:
- Post illegal, counterfeit, or prohibited items (including weapons, regulated substances, or stolen goods).
- Misrepresent your identity or the condition of your items.
- Harass, abuse, or harm another user.
- Use the Platform for commercial "spam" or unauthorized advertising.
- Attempt to scrape, hack, or reverse-engineer the Platform.
5. Intellectual Property
The Barter name, logo (including the "Vedant Yogesh" brand assets), UI design, and software are the exclusive property of Barter and its licensors.
You retain ownership of the photos and descriptions you upload. However, by posting on Barter, you grant us a worldwide, non-exclusive, royalty-free license to display and distribute that content to other users on the Platform.
6. Disclaimers and Limitation of Liability
Warranty Disclaimer
The Platform is provided on an "as-is" and "as-available" basis. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
Limitation of Liability
To the maximum extent permitted by law, Barter shall not be liable for any indirect, incidental, or consequential damages, or any loss of profits or data arising from your use of the Platform or your interactions with other users.
7. Disputes Between Users
Barter is not responsible for resolving disputes regarding the value, condition, or delivery of items. While we may provide "Trust Indicators" or mediation tools to help, the ultimate responsibility for a successful exchange rests with the users involved.
8. Termination
We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or if your conduct poses a risk to the community. You may also delete your account at any time via the Platform settings.
9. Governing Law and Jurisdiction
- Governing Law: These Terms are governed by and construed in accordance with the laws of India.
- Jurisdiction: Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Bengaluru, Karnataka, and the parties hereby consent to personal jurisdiction and venue therein.
10. Indemnification
You agree to indemnify and hold harmless Barter and its affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms or the rights of any third party.
